Probate Information

• Intestate Descent, Title 20, Chapter 21 of the Probate, Estates and Fiduciaries Pa. Code Under Pennsylvania's intestate succession laws, this section determines relative’s shares and interest in a decedent’s estate when there is no will.

Petition for Probate (and Instructions), Renunciation of Appointment and Petition for Probate of Authenticated Copy of Will

• Renunciation (short form) - Print name(s) of parties after the undersigned. Renunciation must be notarized, unless parties appear in person to sign.
• Petition for Probate of Authenticated Copy of Will(PDF, 7MB) - Complete this form and present it when filing authenticated record.
• Affidavit by Foreign Fiduciary(PDF, 814KB) - Use only for a decedent that is not a resident of the Commonwealth of PA.

Estates Granting Letters, Required Filings

• Inventory - Fee is $20.00; plus, an additional cost based on the estate value.
• Heir Notification - Sent to heirs by executor/administrator. No Fee.
• Rule 10.5. Notice to Beneficiaries and Intestate Heirs
  • Application - Certification of Notice Under Pa. O.C. Rule 10.5 - Filed by the executor/administrator. Fee is $10.00. (If filed before 2020)
• Rule 10.6. Status Report by Personal Representative
  • Application - Pa. O.C. Rule 10.6 Status Report - Filed by the executor/administrator. Fee is $10.00. (If filed before 2020 or if filing an Incomplete status report)

Miscellaneous

Personal Representative’s Bond(PDF, 724KB)
To be signed by executor or administrator and filed with Wills/Orphans' Court Division. Bond must be executed by a Bonding Company. Fee is $10.00.
