Title V & Non-Title V Operating Permits
Title V of the Clean Air Act requires major sources of air pollutants, and certain other sources, to obtain and operate in compliance with an operating permit. Sources with these "Title V Permits" are required by the Act to certify compliance with the applicable requirements of their permits at least annually.
Once a permit is drafted, there is a minimum 30-day public comment period, followed by a 45-day EPA review period. Permits are issued for a 5-year term (although the conditions will remain in effect until a new permit is issued).
Title V Operating Permits incorporate the conditions of all existing operating and installation permits, as well as any other conditions necessary to demonstrate compliance with the Clean Air Act and Allegheny County's Article XXI - Air Pollution Control(PDF, 2MB). The issued permit includes the Operating Permit, the Technical Support Document, and the Comment/Response Document.
Expired permits with a received timely and administratively complete renewal application remain in effect until a renewal operating permit is issued. The ACHD is to issue permits within 18 months of a completed application.
The following facilities have never had a Title V Operating Permit issued:
- ATI Flat-Rolled Products (#0059, formerly Allegheny Ludlum) – The permit cannot be completed until new emission factors for the electric arc furnaces are developed through testing. The testing has been completed and the new emission factors are being developed.
